प्रशासक वीपी सिंह बदनोर को गुमराह कर रहा शिक्षा सचिव अरूण गुप्ता: सतिंदर

चंडीगढ 21 May 2020। भाजपा के वरिष्ठ नेता व सीनियर एडवोकेट सतिंदर सिंह ने यूटी प्रशासन को आड़े हाथों लिया है। उन्होंने प्राइवेट स्कूलों में बच्चों को पढ़ाने वाले अभिभावकों पर तुगलकी फरमान जारी कराने पर कड़ी प्रतिक्रिया व्यक्त करते हुए प्रशासक वीपी सिंह बदनोर को चिट्टी लिखी है। इस चिठ्ठी में उन्होंने कहा कि प्रशासनिक अधिकारी प्रशासक बदनोर को गुमराह करने में जुटा है और उन्हें सच्चाई से कोसों दूर रखा जा रहा है। भाजपा नेता सिंह ने कहा कि शिक्षा सचिव IAS अरूण कुमार गुप्ता ने अपने 19 मई 2020 के आदेश में कहीं भी यह जिक्र नहीं किया है कि स्कूलों की वित्तीय हालत क्या है। इस आदेश में गुप्ता की कार्यशैली पर ही सवाल तो खड़ा हो रहा है। सिंह ने गुप्ता से यह भी पूछा है कि वह बताएं कि स्कूल प्रबंधन के साथ हैं या फिर अभिभावकों के साथ।

सीनियर एडवोकेट सतिंदर ने सवाल खड़ा करते हुए कहा कि प्राइवेट स्कूलों का प्रबंधन हाईकोर्ट यह कहते हुए गए थे कि हमारी वित्तीय हालत ठीक नहीं है और स्कूल शिक्षकों को वेतन देने के लिए उनके पास पैसे नहीं हैं। इसलिए अभिभावकों से कोरोना के कारण बकाया रह गई फीस दिलवाने की अनुमति दी जाए। इस प्रकार से स्कूल प्रबंधन के आगे नतमस्तक होते हुए शिक्षा सचिव अरूण गुप्ता ने यह फरमान सुना दिया कि सभी अभिभावक 31 मई 2020 तक हर हाल में स्कूलों में फीस जमा करवाए।

Subject:       Request To withdraw the subsequent order dated 19.5.2020 passed by Sh. Arun Gupta, IAS, Principal Secretary Education, Chandigarh Administration which is inhuman & against the spirit of order, advisories issued by Ministry of Home Affairs – Govt. of India as mentioned in the order dated 30.3.2020 issued earlier by PSE, Chandigarh Administration
             And with  request to direct the concerned authority to pass the speaking order  in the above said case so as to contest the CWP Petition No 7338 of 2020(next date 22.5.2020)  in accordance with the merits of the case.
Vande Matram,
              The applicant namely Satinder Singh, remained elected Municipal Councilor of Ward No 18, Chandigarh from 2011-2016 on BJP ticket and  presently member of Administrator’s Advisory Council of Chandigarh. The applicant wants your interference in the matter urgently in CWP No 7338 of 2020 pending for 22.5.2020 involving the hardships of student’s parents studying in the different  private Schools situated at  Chandigarh  due to imposition of curfew and lockdown in Chandigarh
           The Principal Secretary Education, CHANDIGARH ADMINISTRATION issued order dated 30.3.2020    in compliance  with the orders of Ministry of Home Affairs -Government of India and advisories issued from time to time directing private schools to reschedule the last date for deposit of fee and funds for the session 2020-2021( due in the last week of March/ April 2020)and further directed that the last date will be fixed by giving at least one month time to the parents after the reopening of schools and no late fee will be charged due to Covid 19.
Chandigarh is under Lock Down 4 and the parents are under financial crunch  .The said order is very balanced order as it provides the parents to submit the fees of March and April within one month after opening the school.
                  The said order dated 30.3.2020 is very smartly and tactfully   twisted   to the benefit of the  influential private schools, thereby justifying the virtual  back tracking from original order  dated 30.3.2020 before the  concerned Ministry and Government of India .
               The Powerful   lobby of school management filed petition in  Hon’ble Court on the ground that they are bound to pay and disburse the salary of teachers and other staff  for which they have to generate funds which is possible through the fees  and the court passed  interim order dated 13.5.2020 which is as under:
“Reply be filed within one week from today_____ It is hoped that taking into account the urgency, the Respondent- authority shall take appropriate call before the next date of hearing , after hearing the petitioners”
Now what are  the options left to Administration on the representation of private schools before the next date of hearing before Court :
1. One is to dismiss the contention of private schools in view of orders dated 30.3.2020. The contention deserves to be dismissed as the order  dated 30.3.2020 is  based on MRD guidelines, order and advisories  from time to time  . Moreover, the Private schools has not placed any financial record showing  payment of salary of teachers , supporting staff and other expenses for which  the school need to collect fees , thereby leave the matter to be decided finally by  Hon’ble Courts on merits  so as to show impartial and human  face of the Administration.
2 .Second to accept the major contentions of private schools to achieve favorable orders for private schools and to show in every forum of Administration and in public domain that all has been done under the eyes of Court. Usually Administration does not use the 2nd option to show its sincerity and stand towards the parents who are under financial crunch due to curfew and lock down,
       Now 2nd option has been adopted  without going through and taking into the  records of balance sheet  and without  mentioning the  financial aspects of private school in the subsequent orders  dated 19.5.2020 . The said order has been passed without   visualizing  and observing the fact that the private  school would not  be able to provide salaries to teachers and supporting staff without the payment of tuition fees on or before 31.5.2020. The Principal Sectt, Education did not bother to exhibit the financial status of school in order to infuse faith to the parents in the administrative orders.     The order dated 19.5.2020 was passed with applying mind and  smacks malaise and points towards something has  happened under the table.
           Now what will happen on the date fixed, the private schools will withdraw their petition stating that their most of grievance has been dealth with   and the Writ petition would become infructous  thereby befooling the parents, MHA and Government of India.
          In my opinion, it is a sin committed in connivance with one another by misguiding the Hon’ble Court. The applicant like other parents    feel  that the Administration should contest the case in the Hon’ble Court on the well reasoned first order dated 30.3.2020 as no record showing financial  incapacity by Private Schools has been placed on record as per subsequent  order dated 19.5.2020 .
                  The applicant has tried to bring the facts to your knowledge in order to set aside the subsequent orders dated 19.3.2020 which seemed to be maliciously got approved to help the private influential schools.
            Please look into the matter in view of the facts and circumstances mentioned above in order to give the human face of the administration in this critical time of Covid 19 and restore the order dated 30.3.2020 and direct the concerned authority to pass the speaking order showing  the status and financial capacity of  private schools in order to infuse faith  to the parents in the  administrative orders on or before 22.5.2020 so as to contest the case on merits before the respective Court.
